Terms and Conditions

Any recipient (“Recipient”) who uses the EuroMTS Index website (www.euromtsindex.com or email service) (hereinafter the “Website” or "Email Service") or the EuroMTS®, MTSNext™, EuroMTS Index™, the EuroMTS Indices™, the EuroMTS Inflation Linked Index™, or the EuroMTS Inflation Linked Indices™, EMTX, EMTXi™, EMTXn™ (hereinafter the “Trademarks”) on their own or in relation to (amongst others) the EuroMTS Index™ or EuroMTS Inflation Linked Index™, EuroMTS New EU Index™ (each the “Index” or collectively the “Indices”) comprised on the Website or Email Service (or any information contained in the Indices) is subject at all times to and hereby acknowledges and accepts the following terms and conditions regarding their use and/or distribution.

EuroMTS Limited (“EuroMTS”), its licensors, licensees and/or affiliate companies own(s) the Trademarks and any and all of the intellectual property rights (“Intellectual Property Rights”) and proprietary information related to and contained within the Website or Email Service, Index or Indices (including but not limited to any text, software, photographs, videos, graphics, music, logos, button icons, images and audio clips and any other material and services present on the Website, Index or Indices). Nothing contained within these Terms and Conditions shall be construed as transferring, granting or conferring (either directly or indirectly to the Recipient or any third party any right, title or licence of use or distribution in respect of any Intellectual Property Rights or proprietary information contained or subsisting as aforementioned, unless explicitly set out herein. Neither the Website or Email Service, Trademarks, Index nor the Indices may be used (otherwise than set out hereunder) without the prior written consent of EuroMTS or its licensees, licensors and/or affiliate companies.

The EuroMTS Index™ may, from time to time, be rated by a ratings agency (“Rating Agency”) and any rating or ratings (“Ratings”) provided by such Rating Agencies may be displayed on the Website. The use (by any entity or individual) of any such Ratings shall be in accordance with the terms and conditions provided by the relevant Rating Agency (if any, and displayed on the Website) and in accordance with these Terms and Conditions where applicable.

EuroMTS may from time to time publish reports, research and other information (any or all of the foregoing (or anything similar thereto), the “Published Materials”) on the Website whether created by itself or by other third party researchers (“Researchers”), on its behalf. The Recipient may not distribute, disseminate or transmit any of the Published Materials without the prior written consent of EuroMTS or the Researchers.

The Recipient may use the Website or Email Service (and any information contained therein), the Index or the Indices and their associated Trademarks strictly for their own internal purposes (including for standard analytics “Standard Analytics” such Standard Analytics including but not limited to highs, lows and volatility) but in all cases shall not commercialise, sell or distribute the Index or the Indices (or combined with any other information in order to commercialise, sell or distribute any or all of the product of that combination or the Standard Analytics) in any way whatsoever without the prior written consent of EuroMTS and any such use shall always be attributed to the relevant owner of the Index and/or the Indices and the Trademarks without exception.

In providing the Website or Email Service, Index and the Indices for use under the Terms and Conditions hereunder, EuroMTS is not: (i) providing investment, tax, financial, trading, accounting or legal advice; or (ii) offering or soliciting to buy or sell securities.

The Website or Email Service, Index, Indices, Rating(s) and Published Materials on the Website and any information contained in any of the aforementioned are provided, in all, cases “as is” (whether indirectly or directly) without warranty, condition, undertaking or term of any kind and neither EuroMTS nor the Rating Agency, nor any Researchers (as relevant) make any representations and hereby disclaim any express, implied and statutory warranties (whether now or subsisting in the future) of any kind included but not limited to such warranties is respect of satisfactory quality, merchantability, fitness for a particular purpose, accuracy, timeliness or completeness of the Website or Email Service, the Index, the Indices, the Rating or the Published Materials (as appropriate) for any purpose. Neither EuroMTS, the Rating Agencies nor the Researchers assume any liability for the Website, the Email Service, the Index, the Indices, Ratings or the Research Materials (as relevant) whatsoever (other than as required by law) including no liability for any errors, omissions or interruptions in the provisions of the Indices, the Email Service, Ratings nor the Research Papers.

EuroMTS reserves the right to change, alter, modify, discontinue the Websites and Email Service (or charge for the Index and/or Indices) at any time, in whole or part, either temporarily or permanently and without notice and the Recipient shall be under an obligation to update these Terms and Conditions accordingly.

In using the Website or Email Service, the Index, the Indices and Trademarks, the Recipient hereby submits to the exclusive jurisdiction of the English courts and these Terms and Conditions shall be determined and construed in accordance with English law.
